Anonymous data collection

When you visit our websites, our web servers save, by default, the IP address allocated to you by your internet service provider, the browser you used and its version, your operating system, the website you used to visit us from, our websites that you visit as well as the date and duration of the visit.

Personal data collection

Personal data is only then saved if you provide us with it as part of a product enquiry, a registration, a survey, a competition or to complete a contract for example.

Providing your personal data is neither legally nor contractually mandatory.

Your personal data is stored exclusively on our servers within the Federal Republic of Germany. Transnational forwarding of your data may occur in compliance with applicable laws.

We collect personal data that you submit to us via our websites. Personal data provided by you could include your contact details for example.

After your personal data is collected, stored and processed by our employees, it is generally deleted from our servers after three months provided that it is no longer necessary for its original purpose.

Only employees of CLARK Europe GmbH have access to your personal data. In particular, those from the sales, order processing, marketing and engineering departments. The personal data that you provide is used by our employees and by employees of CLARK Europe GmbH’s sales partners to contact you. Your personal data shall only be disclosed to the respective regional CLARK sales partner. Your data shall not be disclosed for the purpose of advertising outside of CLARK Europe GmbH.

Use and disclosure of personal data and appropriation

We only use your personal data for the purposes of technical administration of our websites, customer management, product surveys and marketing to the extent that is required respectively.

Personal data is only sent to state institutions and authorities within the scope of mandatory legal provisions. We commit our employees, agents, and dealers to maintaining confidentiality.

Choice

We wish to use your data to inform you about our products and services and to consult you about them where appropriate. Of course, participation in such activities is voluntary. Should you not agree with this, you can notify us at any time so that we can lock the data accordingly. More detailed information can be found on the respective website.

Information access rights

Upon request, CLARK Europe GmbH or the representative responsible for you will notify you in writing as soon as possible in accordance with the applicable law, regarding whether and what personal data of yours we have stored. If you are a registered user, we also offer the option of seeing the data yourself and, where appropriate, deleting or editing it. Should it be the case that, despite our efforts to ensure that the data is accurate and up to date, false information is stored, we will correct this at your request.

If you have questions regarding the processing of your personal data, you can get in contact with the responsible office (see above), which is also available for information requests, suggestions, or complaints.

We would like to point out that the transfer of data over the Internet (e.g. when communicating by email) can present security risks. Complete protection of data from being accessed by third parties is not possible. 

The use of the contact data published as part of the legal notice obligation by third parties to send advertising and informational materials which have not been expressly requested is hereby expressly rejected. The operators of the site expressly reserve the right to take legal

measures in the event of unsolicited sending of advertising information, such as spam emails.

Right to receive a copy

You are entitled to request a free copy of all processed data from the responsible office. A proportionate fee may be calculated for additional copies. The right to receive a copy may not impair the rights of others. The commercial secrets and intellectual property of third parties may conflict with the right to receive a copy.

Right to withdrawal and deletion

You are entitled to withdraw your consent to the future use, processing and disclosure of your personal data, at any time, or to request the correction of false information or the deletion of your data provided that this does not conflict with any legal obligations to preserve records. Right to file a complaint with the regulatory body

You are entitled to file a complaint with the regulatory body if you believe that the processing of your personal data is in violation of the EU General Data Protection Regulation [GDPR (EU) 2016/679 of the European Parliament and the Committee from 27/04/2016 on the protection of individuals with regard to the processing of personal data, the free movement of such data and the repeal of the 95/46/EC guideline, OJ L 119 as of 04/05/2016, p1] or the Federal Data Protection Act [FDPA – as of 14/01/2003 (Federal Law Gazette I p66), last amended on 28/04/2017 (FLG I p968)].

Newsletter

On our website, we offer the option to subscribe to our newsletter. We use the newsletter to inform you of our offers at regular intervals. In order to be able to receive our newsletter, you will need a valid e-mail address. For this reason, we will verify the e-mail address that you submit to ensure that either you are the genuine owner of the provided e-mail address or that the owner has consented to receive the newsletter. When you sign up to our newsletter, we will save your IP address as well as the date and time of your registration. In the event that a third party misuses your e-mail address and subscribes to our newsletter without your knowledge, this serves as insurance on our behalf. We do not collect any additional information. Data collected in this way is used exclusively for the purpose of our newsletter. It will not be disclosed to third parties. It will also not be compared with data collected through other parts of our sites. You can unsubscribe from the newsletter at any time. Contact options

On our website, we offer the option to contact us via e-mail and/or via a contact form. In this case, the details you provide are saved for the purpose of processing your contact data. In an enquiry, this will be forwarded to the relevant dealer. It will not be compared with data collected through other parts of our sites.

Comment options

On our website, we offer the option to leave comments on individual contributions. The IP address of the commenter/subscriber is saved in doing so. This saving is for our own security in the event that the commenter interferes with the rights of third parties with their comment and/or posts illicit content. We therefore have a vested interest in the commenter’s saved data since we could be prosecuted under such circumstances. It will not be disclosed to third parties. It will also not be compared with data collected through other parts of our sites.

Cookies

We use cookies in order to keep track of visitor preferences and to allow for the optimal design of our websites. Cookies are small data files which are stored on your end device. This makes it possible to facilitate navigation and allows a high level of usability on a website. In particular, cookies also help us to identify popular areas of our website. AWStats server statistics

Data that your browser sends to us is automatically saved in the server statistics.

This includes:

- Browser type and version

- Operating system used

- Referrer URL (previously visited page)

- Host name of your computer (IP address)

- Time of server request

- The search term used to find the site e.g. via Google

In general, this data cannot be attributed to specific users. This data is not combined with data from other sources and is deleted following statistical evaluation.

Use of the Piwik web analysis service

We use the web analysis service, Piwik, on our website. Piwik uses cookies for its analysis. Cookies are text files which are stored on your computer to help the website analyse how you use the site.

The information generated by the cookies, such as time, location and frequency of website visits, including your IP address, is sent to our server and saved there. Your IP address shall be immediately anonymised in this process so that you as a user are anonymous to us.

The information regarding your use of this site which is generated by the cookies shall not be passed on to third parties. You can prevent the installation of cookies via the corresponding setting in your browser software; we would also point out that in this case you may not be able to completely utilise all functions of the website.

If you do not consent to the saving and use of your data, you can deactivate it here. In this case, an opt-out cookie shall be stored in your browser, meaning that Piwik will not be able to collect any usage data.
